What Is a Property Title Deed in Argentina?

The escritura pública (public deed) is the legal instrument that transfers ownership from seller to buyer. Without it registered at the Property Registry, no legally recognized ownership transfer exists.

The Deed Value Question

Historically, properties were sometimes registered below their actual sale price to reduce taxes. This practice is decreasing due to tighter enforcement since 2023–2024. Recommendation: register at actual value — understating deed value creates larger taxable gains on future sale.

Step-by-Step Process

2–4 weeks before:

  • Notary requests title report, seller inhibition check, maintenance fee clearance, utility debt clearance
  • On the day:

  • Deed read aloud, all parties sign
  • Buyer pays remaining balance (cash USD, wire transfer, or certified check)
  • Seller hands over keys
  • Post-deed:

  • Notary registers deed at Property Registry (15–60 days)
  • Buyer receives original deed
  • Special Cases

  • Mortgage purchase: bank also appears as a party; times are longer (additional 30–90 days for credit approval)
  • Inherited property: requires prior declaration of heirs if not yet registered — can add months
  • Foreign buyer: needs CDI tax ID instead of CUIT
  • Choosing Your Notary

In Argentina, the buyer chooses the notary. Request a written fee quote before starting, look for local market experience, and use recommendations from your real estate agent or trusted contacts.
